In part one, Mr. Johnston details his firsthand account of holding pharmaceutical giants accountable and the lessons he has learned in his career as a trial lawyer.
Listen as Mr. Johnston recounts one of his most notable cases against Upjohn, the pharmaceutical company behind the sleeping pill Halcion. During the trial, Mr. Johnston demonstrated that the drug’s side effects led to violent hallucinations, which in turn caused a police officer to fatally injure his best friend while under its influence.

In part two of the podcast, an episode titled “Taking Big Pharma to Task,” shareholder Randy Johnston discusses the aftermath of the Halcion verdict, his pragmatic strategies for holding reckless companies and professionals accountable and his fight against tort reform.
“I’ve always been amazed at how indignant lawyers get when I send a demand letter saying, ‘I think you did something wrong here. I’m going to sue you,’ and two hours earlier, they sent a letter to a doctor, stockbroker, an accountant, or someone saying the same thing, but they think they should not be held to that same standard. That level of hypocrisy just offends me,” Mr. Johnston told Outside Counsel.
