Managing shareholder Chad Baruch spoke with the Austin American-Statesman about the Texas Supreme Court ruling against Dallas County in an article titled “Was the creation of 15th Court of Appeals constitutional? Texas Supreme Court weighs in.”
The article details the court’s decision to side with the state’s legislature in the dispute over the constitutionality of the new 15th Court of Appeals, which is set
to begin hearing arguments on September 1. The court will hear arguments in cases regarding constitutionality of state legislation and matters from Texas’ new business courts.
Mr. Baruch, who is frequently called up to discuss constitutional issues, says the decision was consistent with past interpretations.
“The constitutional history in Texas has been toward greater legislative discretion as opposed to less legislative discretion,” Mr. Baruch told the Austin American-Statesman,
adding “the idea that there has to be some strict, rigid geographical limitation to an appellate court’s authority is undercut” by the common practice of transferring cases between appellate courts.
